Dr. Martin Greenberg is accused of using his own sperm to artificially impregnate Bianca Voss in 1983, in what some people are calling “medical rape.” The 75-year-old woman, who sought out a sperm donor almost 40 years ago, filed a civil complaint against her fertility doctor on Tuesday, claiming that he inseminated her with his sperm without consent.
According to the federal lawsuit filing, Bianca Voss paid Dr. Martin Greenberg to secure sperm from an anonymous donor. Instead, the New York City OB-GYN allegedly used his own sperm to conduct the procedure, which led to a healthy pregnancy and the birth of Roberta Voss, Bianca’s daughter, in 1984.
It was after Bianca Voss’s daughter used a 23andMe DNA kit in the fall of 2020 that she discovered that her biological father was in fact, Dr. Martin Greenberg, who left New York and is now living in Florida.
The lawsuit said that “some people call this horrific act ‘medical rape, but regardless of the name, Greenberg’s heinous and intentional misconduct is unethical, unacceptable, and illegal.” Greenberg, who charged Voss $100 to find an eligible donor at the time, had reportedly asked if she minded the ethnicity or religion of the individual.
Bianca Voss just “wanted someone anonymous,” according to her statement to NBC News reporters. “He did say, ‘Do you mind the donor is Jewish?’ And I said, ‘no,’ and that was it. I kind of thought it might be a medical student from the hospital, but that was it. And then he asked me for the check for $100 to cover the donor, his inconvenience.”
Voss’s lawyer, Jason Kane, claims that “Dr. Martin Greenberg inserted his own sperm into this patient, Bianca Voss,” and that “he did so without her consent and against her wishes.” Since finding out that Greenberg used his sperm for the procedure, Voss is feeling “victimized.” The woman, who resided in Manhattan’s Upper West Side at the time of the pregnancy, is now coping with “debilitating anxiety and emotional pain,” according to the lawsuit.
The lawsuit states that Voss would not have allowed Greenberg to use his sperm for the procedure, though one of her lawyers does admit that she placed no restrictions on who the donor could be. However, “Bianca never ever thought her doctor was inserting his own sperm into her, which she thinks is gross.”
Roberta Voss is also coping with what seems like a new reality. “There in black and white, Dr. Greenberg,” Roberta said after Greenberg “was identified as my father.” She continued, saying “not my possible father, not someone sharing a lot of the same DNA characteristics, it says flat out, he is my father.”
The daughter claims “it’s horrifying to look in the mirror and see the person who violated my mother and I see his face every time I look in the mirror. I’m in turmoil about who I am, what this means, and what kind of person would do this? And is that a part of who I am? And what about my son?”
According to the lawsuit, Bianca Voss is not seeking a particular financial figure, but that “the amount in controversy exceeds $75,000, exclusive of interest and costs.” Voss is not only suing Dr. Martin Greenberg for monetary damages but wants to unveil his medical history so her daughter and grandson are better prepared.
The lawsuit claims that Bianca and Roberta Voss are “aware that Greenberg’s son unfortunately passed away at an early age,” and “wanted to know if [Roberta] may have inherited a concerning medical condition.” They “also wanted to know if [Roberta] may have passed on such a condition to her own child.”
